Dispute Process What if the item is not received or not as described? What is the process to resolve this and how does it work? The item not received or not as described process can help buyers and sellers to resolve the dispute by way of communication and improved ARC*. This process helps transactional partners work out their problems when a buyer believes he or she had not received an item, or believe they have received an item that is significantly different from what was described in the listing. The Item Not Received process consists of two steps: The first step is for the buyer to open a dispute after not receiving an item or receiving an item that they believe is Significantly Different** from that which was described in the listing. In the second step, the buyer and seller communicate directly to resolve the issue. Most problems can be resolved through this direct buyer and seller communication. If the buyer and seller cannot reach agreement or resolve the situation, the buyer can escalate the dispute to a third step by filing a claim through the Feedback Page. In this case both parties present their case backed up with any physical evidence, photocopies scans, emails, etc and freezoneaction.com will make a judgement which will be final. It is not expected that this last resort will be required as most disputes will be resolved with proper communication between the transaction parties. Where the freezoneaction.com is used as a mediator to resolve the dispute a fee will be charged equivelent to 5% of the final bid the cost of which will be split between both transactional parties equally at the end of the resolution and decision. Significantly different** An item is significantly different or "not as described" if the item varies greatly from what was described in the item listing. This does not include cases where the buyer is disappointed with the item and/or it did not meet the buyer's expectations. The condition of the item must affect its value or usability to fall under the "not as described" category. If the buyer and seller cannot resolve the issue on their own, Freezone Auctions will ultimately determine whether the item is "significantly not as described." or not on a factual basis and not one of opinion. top
